产品缺陷产品存在的危及人体健康、人身、财产安全的不合理的危险。是产品责任得以存在的基本条件之一。包括设计上的、制造上的和指示上的缺陷。设计上的缺陷指产品在设计上存在不安全、不合理的因素。制造上的缺陷指产品在加工、制作、装配等过程中未达到设计精度指标的要求，或者不符合加工工艺要求，致使存在不安全的因素。指标上的缺陷指产品在可能危及人体健康、人身、财产安全方面，未履行或未适当履行法律规定的标识义务，缺乏必要的警示说明，致使消费者在使用中产生危险。 产品缺陷是产品责任理论中的一个重要概念，许多国家的法律通常对此作出专门规定。《美国统一产品责任示范法》规定，产品缺陷指产品制造上存在不合理的不安全性，或者产品设计上存在不合理的不安全性，或者未给予适当警告或指示，致使产品存在不合理的不安全性，或者产品不符合产品销售者的明示担保，致使产品存在不合理的不安全性。《欧洲经济共同体产品责任指令》规定，考虑到产品的说明，能够投入合理期待的使用以及投入流通的时间等情况，如果产品不能提供人们有权期待的安全性，即属于缺陷产品。英国1987年的《消费者保护法》规定，如果产品不具有人们有权期待的安全性，该产品即存在缺陷。安全性包括组合到另一产品之中的产品的安全性，以及在造成死亡、人身伤害危险方面的安全性。《中华人民共和国产品质量法》第34条对缺陷的含义也作了专门的规定:本法所称缺陷，指产品存在危及人身、他人财产安全的不合理的危险;产品有保障人体健康、人身、财产安全的国家标准、行业标准的，指不符合该标准。 产品缺陷的内含不同于产品质量不合格。判断产品是否有缺陷，产品标准是一个重要依据，但并不是唯一的也不是绝对的依据。判断产品是否有缺陷需要考虑很多因素，如提供产品的时间、可合理期待的产品的用途等。
