【土地权属】土地所有者对其拥有的土地所享有的占有、使用、收益和处置以及土地使用者对其所使用的土地所享有的利用和取得收益的权利。即土地的所有权和使用权。旧中国，大部分土地属于帝国主义、官僚资本主义和地主阶级所有。新中国成立以后，根据宪法的规定，城市市区的土地属于全民所有，即国家所有;农村和城市郊区的土地，除法律规定属于国家所有的以外，属于集体所有;宅基地、自留地、自留山属集体所有。国有土地和集体所有土地的使用权可以依法转让和出让。土地的所有权和使用权均受法律保护，任何单位和个人不得侵犯。在依法改变土地权属关系时，必须办理土地权属变更登记手续，更换证书。在土地权属发生争议时，由当事人协商解决。在协商不成的情况下，应由人民政府负责处理。在土地权属争议解决以前，任何一方不得改变土地现状，不得破坏土地上的附着物。
