环境损害经济赔偿由于某单位或个人造成环境污染或环境破坏而使另一部分未参与此种活动的人受到健康危害、财产损失或生存条件严重恶化而由加害人给予被害人的一定的经济赔偿。环境损害的经济赔偿是环境保护法规定的基本法律责任之一。《中华人民共和国环境保护法》第四十一条规定:造成环境污染危害的，有责任排除危害，并对直接受到损害的单位或者个人赔偿损失。赔偿责任和赔偿金额的纠纷，可以根据当事人的请求，由环境保护行政主管部门或者其他依照法律规定行使环境监督管理权的部门处理。环境损害的经济赔偿与一般民事损害赔偿相比较，具有如下特点:①诉权扩大。②无过失责任制的应用。③举证责任的转移。④因果关系的推定。中国环境保护的经济赔偿大多是污染事故造成的，如1992年的污染事故赔偿总额为5 190.6万元。对于建设项目造成的土地占用、淹没，或为预防事故发生可能造成的危害而进行的搬迁方面的经济补偿等，虽也属于环境损害的经济赔偿，但一般由当事双方商定或通过各级政府的协调解决，并不诉诸法律。对因环境变化而必须搬迁的居民，国家规定要使其居住条件比搬迁前有所改善。
