Today environmental servitude has been used in many field of environmental protection, for example: the servitude of resource development, the servitude of use of environment, and the servitude of environmental protection.

This paper analyzes the characters of pollutant emission right,illustrates the feasibility of pollutant emission right dealing system,based on the newly-issued Chinese Law of Property,shows that environment exerts challenges on traditional laws,defines the pollutant emission right from a new perspective and presents a suggestion establishing a new environmental servitude right.
