| 无因管理 voluntary service 未受他人委托，又无法律义务而为他人管理事物的事实行为。债的发生根据之一。例如为牧场管理一群迷失的牲畜，代理邻居修理其外出期间即将倒塌的房屋等。基于法律规定，上述行为导致一定的法律后果，引发债权债务关系。管理他人事务的人称管理人，被他人管理事务的人称本人。通常管理人是债权人，本人是债务人。 无因管理的特征为：管理人要有管理他人事务的行为；必须要有为维护他人利益而进行管理的意思；必须是没有法律的义务，即既没有法律规定的义务，又没有合同规定的义务。 管理人的义务包括：管理义务。在无因管理开始前，管理人对于他人的事务固然没有管理的义务；但一经开始管理，则管理人在本人、其继承人或代管人接管以前负有继续管理的义务。尊重本人意思和维护本人利益的义务。管理人应将管理情况及时报告本人，按本人意思办理。权益转移义务。管理人因管理事务所取得的财产及其他权益的应转移给本人。本人的义务包括：偿还管理人因管理事务而支出的合理费用；清偿管理人因管理事务负担的债务；赔偿管理人因管理事务所受的损失。 |
