国土资源部《全国工业项目建设用地控制指标(试行)》与一些地区产业用地指南出台标志着宏观调控后国家与地区政府对产业引入在土地利用政策方面发生的变化,本文从这些标准出台的背景因素出发,以《上海产业用地指南》为例,通过对产业用地指南编制办法的探讨,对其的实效性与其对完善城市规划编制、研究的意义进行了分析,认为产业用地指标对于城市政府在产业引入时集约化利用土地能起到较好的指导作用,也能弥补以往城市规划与研究在产业用地方面的不足;但产业用地指标却并不能实现城市产业经济发展的战略目标,即构建具自身竞争力的产业等级体系。

答：用地单位有下列情况之一者，该用地由城市规划行政主管部门收回另行处理：
1、不按批准的用途使用的；
2、用地单位民已经撤消或迁移的；
3、未经城市规划行政主管部门同意延期，连续两年未使用的；
4、建设用地规划许可证被吊销的；
5、市政设施、军事设施、铁路、公路、机场、抗场等用地经过核准不用的；
6、用地单位因建设计划变更不再使用或多余的；
7、用地单位闲置的土地；
8、未取得建设用地规划许可证而取得建设用地地批准文件、占用土地的；
城市规划行政主管部门有权根据城市规划建设需要，对城市规划区内的土地进行再按排。
