房地产信托


【房地产信托】也叫不动产信托。即受托对土地和地面固定物进行管理和处理的信托业务。主要代办房地产的买卖、租赁、收租、保险等代管代营等业务,以及房地产的登记、过户、纳税等事项。有的还受理其他较广泛的代理业务,如土地的丈量,建筑物的设计和绘图,建筑工程的承包,房地产的鉴定及评价等。办理该业务需要有专门的知识和经验,一般银行对其由本身资金所投资的房地产,亦委托信托公司代管代营,或专设业务部门经办。西方资本主义国家的银行经营房地产信托业务的主要方式有:(l)经租管理房地产。银行接受房地产业主委托,双方签订经租合同,明确双方权责利;房地产出租时,银行依照委托人约定的租金数目办理,与承租人订立“租屋合同”,按期收取房地租金,扣除应收的手续费再定期汇交委托人。(2)代理买卖房地产。凡需购买或出售房地产的客户均可委托银行物色适当的卖主和买主,成交后,银行收取一定的手续费;银行还兼办房地产的过户等事宜。(3)土地执业信托。银行受房地产业主的委托,全权代理执管产业,收取一定的手续费。(4)办理有关房地产业务的资金存、放款业务。
