委托人的介入权：指的是在受托人与第三人的合同关系中，委托人订立合同时，委托人取代受托人的地位，介入到本来是受托人与第三人之间的合同关系中，行使受托人对第三人的权利，委托人介入权的行使条件是：第一，受托人以自己的名义与第三人订立的合同本来直接约束受托人与第三人的，即第三人于受托人以自己的名义与其订立合同时，不知道委托人与受托人之间的委托关系；第二，第三人不履行合同义务间接影响委托人的利益，；第三，受托人向委托人披露了第三人，委托人在受托人向其披露第三人后，行使介入权的，应当通知受托人和第三人，于通知到达第三人后，委托人取代受托人在受托人与第三人的合同关系中的地位，可行使受托人对第三人的权利，委托人不行使介入权的，当然应由受托人行使对第三人的权利，若第三人与受托人订立合同时如果知道该委托人就不会订立合同时，委托人就不能享有介入权，受托人仍由自己行使对第三人的权利，委托人不能对第三人行使委托人对第三人的权利。《民法》第一版，北京大学出版社，魏振瀛主编
