【土地收益权】土地所有者、使用者或他人依法收取土地所产生的自然或法定革息和利益的权利，包括收获土地上生长的农作物，收取出租土地的地租等。土地收益权中收取农作物的权利归土地使用者行使，收取地租的权利则一般归土地所有者行使。在土地转租等条件下，土地使用者可拥有取得部分地租的权利。它是一种不完整的土地所有权或使用权。权利人也可以不是土地权属单位和个人。例如，地产主遗嘱中规定儿子是地产继承人，而夫人可获得地产上的收益，夫人的这种权利就是收益权。但在这种情况下不能把权利出卖或抵押，一旦权利人死亡，这种权利则自动消失。
