zu’ai lunshi xingdongZui阻碍军事行动罪(erim。。f。bstruetingmilitary operation)故意阻碍武装部队的军事行动，造成严重后果的行为。属危害国防利益罪。本罪的基本特征:①侵犯的直接客体是武装部队的军事行动。“军事行动”、是指为达到一定政治目的而有组织地使用武装力量的活动。犯罪对象为武装部队，包括中国人民解放军、中国人民武装警察部队、预备役部队和民兵组织。②客观方面表现为阻碍武装部队军事行动，造成严重后果的行为。“阻碍武装部队军事行动”，是指采取设置交通障碍，煽动群众围堵，停止水、电、气等供应，污染饮用水源，使用电波干扰军事通讯、军用计算机等方法，故意阻止、妨碍武装部队进行作战、演习、训练、修筑军事设施、部署兵力兵器、实施戒严等履行职能的活动。“造成严重后果”，通常是指因阻碍武装部队军事行动而贻误战机的;致使战斗、战役或者其他军事行动遭受损失的;影响部队完成重要任务的;造成人员重伤死亡，武器装备、军事设施、军用物资严重毁损或者其他严重经济损失的，等等。③犯罪主体为一般主体。凡达到刑事责任年龄，具备刑事责任能力的自然人，均可成为本罪的主体。④主观方面是故意，即明知是武装部队的军事行动而予以阻碍。过失不构成本罪。根据《中华人民共和国刑法》第368条第2款的规定，犯本罪的，处5年以下有期徒刑或者拘役。(田龙海)
