旅客要求承运人保证人身安全的权利：该权利不仅是旅客的主要权利，亦同样是承运人的法定义务。承运人在运输中要采取各种措施，确保旅客的安全，根据我国的《合同法》第３０２条的规定，在运输过程中旅客伤亡的，不论是持正常票的旅客还是按规定免票、持优待票 或者经承运人许可搭乘的无票旅客，除承运人能够证明伤亡上旅客故意、重大过失造成的或者伤亡是旅客自身健康原因造成的以外，承运人均应承担损害赔偿责任，可见承运人对于运输过程中旅客伤亡承担无过错责任，其免责事由只有两条：第一；旅客的故意或者重大过失，如果旅客对于伤亡的发生只有一般过失，则承运人不能免责；第二：旅客自身健康原因伤亡，如果非旅客自身健康原因而是因第三人行为造成、旅客伤亡的，则承运人不能免责。《合同法》第３０３条的规定
