【非立法监管】在英国法律往往由习惯法原则来代替，这使得英国的银行业监管具有非立法的特点。所谓“非立法”指:(l)除少数在法律上对银行从事某项活动的规定外，整个银行业的管理是由银行同业组织进行的自我管理;(2)英格兰银行是银行业监管的权力机关，但其权威力量的获得是由于作为中央银行在观念上拥有的力量，其对银行业监管的作用发挥的有效性仅取决于银行对它的认可程度。英格兰银行对银行业的监管仅表现在它在重大事件中的干预行动。 根据1946年英格兰银行法，英格兰银行在认为必要时可向银行索取资料报告并向银行提出建议，并可在财政部批准下向银行发布指令，要求其采取行动。但事实上，这一权力从未被行使过，在英国，中央银行更愿采取自愿主动协作的做法。虽然法律规定了英格兰银行有审查银行帐册的权利，但这一权利也从未主动行使。 英格兰银行对银行业活动的管理制度是灵活的、共同参与的;但由于缺乏法律规定，英格兰银行的监督必须是各有关银行自愿接受的。这种制度缺乏必要的强制力，到·70年代，英格兰二级银行业发生了严重危机。这一危机带来了以l卯9年银行法为标志的英国银行向“立法监管”的转变。同时，这也是欧共体银行业管理协调的产物。
