海事仲裁双方当事人协议将海事争议交由第三者仲裁的方法。当事人可以在合同中订立仲裁条款或事后达成仲裁协议，选择仲裁机构和仲裁员。仲裁员具有航海贸易及法律的专门知识。裁决一般是终局性的，对双方具有约束力，必须执行。如果一方对裁决有异议，拒不执行，另一方可提请法院强制执行。早在14世纪，地中海沿岸各港口采用的《海事法典》中就有裁决解决争议的规定。此后为多数国家所公认，其制度也日趋完善。目前国际上的主要海事仲裁机构有:巴黎海事仲裁院，伦敦海事仲裁协会，美国海事仲裁协会等。中国国际贸易促进委员会下的海事仲裁委员会，是中国解决涉外海事争议的常设机构，受理有关海上船舶救助、船舶碰撞及海上租赁、船舶代理或其他双方当事人要求仲裁的争议。
