| 刑事侦查学 criminalistics 以实现刑法和刑事诉讼法的任务为目的，为揭露犯罪、揭发与证实犯罪人而研究如何查明案情，收集证据，查缉罪犯的方法、措施以及技术手段的科学。又称犯罪侦查学，曾称为犯罪对策学。
刑事侦查学的内容包括3个部分 ：①侦查技术。研究如何发现、固定、收取和检验痕迹、物证的原理和方法。其中有：同一认定的理论、刑事照相、痕迹检验、枪弹检验、文书检验、笔迹检验、刑事登记、外貌识别等。侦查技术又称刑事技术，是在综合利用物理学、化学、生理学等科学技术原理和成就的基础上，为了解决对一定的人或物进行同一认定而形成的一类专门技术。②侦查措施。研究实施各种侦查措施的有效方法和策略。其中有：现场勘查、侦查实验、调查访问、查缉人犯、辨认、讯问等。③侦破方法。研究如何根据各类案件的特点，综合运用各种技术手段和侦查措施，以组织力量、查明案情、收集证据、缉捕罪犯。其中包括：杀人案件侦破方法、放火案件侦破方法、抢劫案件侦破方法、强奸案件侦破方法、盗窃案件侦破方法、诈骗案件侦破方法，等等。刑事侦查学所研究的技术手段、侦查措施和侦破方法是密切联系的。侦察措施往往要利用种种技术手段，侦查方法必须综合运用种种侦查措施和技术方法。其运用是否正确，直接影响侦查和调查手段的有效性。运用得好，可以收集到能够据以肯定或否定犯罪事实和审查嫌疑人是否有罪的证据。所以，研究刑事侦查学，有助于提高侦查办案的质量，使国家的侦查权、审判权的正当行使，获得方法上、技术上的保证。 刑事侦查学是随着近代国家制度、司法制度以及科学技术的发展而逐渐建立起来的。在封建专制国家中办理刑事案件，采取纠问主义的诉讼程序，实行坐堂问案和刑讯逼供。近代资本主义国家反对封建审理体制的罪行擅断主义，代之以侦查和公诉的制度，将侦查列为诉讼程序，载入法典，并在侦查实践中日益广泛地运用科学技术的成就，随之在学术上也出现了刑事侦查学。 中国近代曾出版过有关警察科学的著作。这些著作多限于各种侦查技术手段的介绍，还没有形成刑事侦查学的科学体系。 中华人民共和国建立后，为了研究揭露犯罪、证实犯罪的有效方法，加强同刑事犯罪的斗争，在总结中国侦查工作经验和学习国外先进技术的基础上，建立了刑事侦查学。在大学法律系和政法学院中，刑事侦查学是必修课之一。 |
