In a narrow sense duty right infringement liability refers to the behaviour of the state organ or the government officials in the process of government administration infringing the legal rights of the citizens or the juridical persons.
职务侵权责任具有责任主体的特定性、赔偿原因的职权性、可归责的违法性以及权益的实际受损害性几个方面的法律特征。

【侵权责任】民事主体违反法定义务，侵害他人民事权利(包括财产权和人身权)时，依法应承担的民事法律后果。分为过失(疏忽)的侵权行为和严格责任的侵权行为。有些西方国家的法津，还有绝对责任的侵权行为。侵权的民事责任不是当事人约定的，不以合同内容为约束，而是违反法定义务或侵犯他人法定权利的行为的法律后果。侵权的民事责任，广泛适用过错责任原则，同时还使用无过错责任(严格责任)原则，如缺陷产品造成他人伤害时制造者应承担责任等。
