The first type is separate tort in which the infringing parties assume separate liabilities and the later is joint tort in which the infringing parties assume the joint and several liability and sort out their respect.

单独海损
单独海损在海上航行中，由于自然灾害或意外事故造成保险标的的损失，这种损失不是共同海损行为引起的，而是属于单独方利益的损失，这种单独损失由单独的所有人或其承保人自行负担。单独海损的损失是此保险标的本身，不包括单独费用。在英国的海上保险单中规定:如保险合同订约双方无特别约定，则保险人对单独海损的责任要受到附注条款的限制。限制的内容有:对某些货物的单独海损必须超过约定的免赔率才赔，对船舶和运费必须超过约定的免赔额才赔等等。目前这种限制正逐渐取消，因为保险人可以通过调整保险费率来扩大这部分责任。
