代位赔偿请求权：法国行政法术语，在公务执行中或公务执行以外，如果公务员过错或公务员本身过错同时存在，则先由行政主体负全部全部赔偿责任。然后由行政主体代为受害人取得对公务员本人的赔偿请求权。这种理论实际上不承认行政主体对公务员过错所受到的损失由直接请求赔偿的权利，于国家财政不利，也降低公务员对执行公务的注意程度不利于提高行政效率，因此在1915年，最高行政法院的判例放弃了代为赔偿请求权理论，认为行政主体由于公务员的过错而受到损害时，无需法律的特定规定，可根据损害赔偿的一般原则，直接要求公务员赔偿。――――《法学大辞典》第一版，中国政法大学出版社。总主编，邹喻，顾明。
