补充资料:跟单票据争议专家解决规则
  《跟单票据争议专家解决规则》(ICCRulesforDocumentaryInstrumentsDisputeResolutionExpertise,DOCDEXICCPublicationNo.811)是由国际商会的银行技术与实务委员(ICCCommissiononBankingTechniqueandPractice,简称“银行委员会”)制定并于1997年10月公布实施的,2002年3月修订。解决由于适用“跟单信用证统一惯例”(UniformCustomsandPracticeforDocumentaryCredits,UCP)和“跟单信用证项下银行间偿付统一规则”(UniformRulesforBank-to-BankReimbursementsunderDocumentaryCredits,URR)而引发的争议。为适应新的形势要求,银行委员会于2002年3月修订时,将DOCDEX的适用范围扩展到其它的国际商会规则,包括《托收统一规则》和《见索即付保函统一规则》,以使更多的用户可从中获益,因而相应地将DOCDEX的名称也由原来的《跟单信用证纠纷专家解决规则》(DocumentaryCreditsDisputeResolutionExpertise,ICCPublicationNo.577)调整为《跟单票据纠纷专家解决规则》。
根据此规则,信用证当中的任何一方当事人与其他当事人就信用证产生了争议时,可以向国际商会设在法国巴黎的国际专业技术中心提出书面申请,由该中心在银行委员会提名的一份专家名单中指定三名专家,根据当事人陈述的案情和有关书面材料,经与银行委员会的技术顾问协商后,就如何解决票据争议以该中心的名义做出决定,称为DOCDEX裁定(Decision)。DOCDEX是传统的仲裁或诉讼以外的新近发展起来的一种快捷高效的票据纠纷解决方式。
