| 剥夺政治权利 deprivation of political rights 审判机关依法剥夺犯罪分子在一定时期内享有法律规定的政治权利的一种刑罚。在中国，所剥夺的政治权利的内容是：选举权和被选举权 ；言论、通信、出版、集会、结社、游行、示威等权利 ；担任国家机关职务的权利；担任企业、事业单位和人民团体领导职务的权利。 中国刑法规定，剥夺政治权利是一种附加刑，也可以独立适用。对于反革命分子，被判处死刑、无期徒刑的犯罪分子都应附加剥夺政治权利；对于严重破坏社会秩序的犯罪分子，必要时也可以附加剥夺政治权利。在独立适用时，它是作为不剥夺犯罪分子人身自由的刑罚。附加剥夺政治权利的期限，独立适用时为1年以上5年以下。判处管制附加剥夺政治权利的期限与管制的期限相同，同时执行；判处有期徒刑、拘役附加剥夺政治权利的期限为1年以上5年以下；判处死刑（包括死刑缓期执行）、无期徒刑的犯罪分子，剥夺政治权利终身；死刑缓期执行减为有期徒刑或者无期徒刑减为有期徒刑时，剥夺政治权利的期限改为3年以上 10年以下。附加剥夺政治权利的刑期，从有期徒刑、拘役执行完毕之日或者从假释之日起计算；剥夺政治权利的效力当然施用于主刑执行期间。没有被剥夺政治权利的罪犯，在主刑执行期间，仍然享有政治权利。 |
