In order to protect the labor s basic human rights, under current China national conditions, there is a necessity that the discharge of labor claims takes precedence over the secured debts for maintaining the social stability and realizing fair justice.
破产法上的劳动债权具有优先权的属性,其与担保债权在破产清偿顺序上存在冲突。

Although the recently-enacted Enterprise Bankruptcy Law of China prescribes that labor claim shall possess the first position to be satisfied, labor claim always can’t be satisfied when total property of a bankrupt enterprise has been set guarantee for loan.
现行破产法虽然规定了劳动债权对破产财产享有第一顺位的优先受偿权,但在破产企业将其全部财产用于特定债务的担保时,劳动债权常常无法得到清偿。
