中国纪传体史书篇目名,志书的一种。始创于汉代班固的《汉书》。此后各纪传体断代史多相沿用。如二十四史中的《晋书》、《魏书》、《隋书》、《旧唐书》、《新唐书》、《旧五代史》、《宋史》、《辽史》、《金史》、《元史》、《明史》等，以及民国初年编的《清史稿》，都撰有"刑法志"（《魏书》称"刑罚志"）。刑法志主要记载封建王朝法律和司法制度方面的重要史料，内容一般包括：①法律和刑法的起源、性质、目的、作用以及礼与刑的关系；②刑事立法的指导思想和刑事法律、法令的修订大略;③刑法的沿革变迁及其得失;④重要罪名、刑种和刑罚制度的创制与发展；⑤审判制度概况;⑥监狱制度以及刑具的规格与使用概况,等等。内中往往夹有作者的评论。《汉书·刑法志》、《晋书·刑法志》等，还保存了许多前朝史书中所没有记载的可贵资料。近代人丘汉平为了汇集刑法志资料,曾编著《历代刑法志》一书,于1938年7月由商务印书馆出版。其中除收入上列各刑法志及其注释全文外，并从各没有编修刑法志的断代史《纪》、《传》中收集有关材料，汇成《后汉刑法志》、《魏刑法志》和南北朝各朝刑法志编入，另收入清代汪士铎撰《南北朝刑法志》和明代宋濂撰《元刑法志》，作为附录。
