| 集团诉讼 class action 当事人一方为一个庞大集团的诉讼。英国衡平法院最早实行和推行这一制度，以后传入美国及英联邦的许多国家 ，成为英美法系中重要的民事诉讼制度，并逐渐为许多大陆法系的国家所采用。 集团诉讼实质上是共同诉讼制度与诉讼代理制度的结合，是在共同诉讼的基础上，吸收代理制度的某些特征而形成的诉讼形式。在诉讼主体上，当事人一方由多数人构成，属于诉讼的主体合并。但是，集团诉讼一方当事人不受数量的限制，而共同诉讼的主体人数实际上要受到限制。在诉讼客体上，集团诉讼或者是基于同一事实或法律问题而对诉讼标的具有共同的利益，或者是对同一种类的诉讼标的存在相同的诉讼请求。因此，集团诉讼既可能类似于必要共同诉讼，也可能与普通诉讼相像。集团诉讼的代表人具有当事人与代理人的双重身分，因而这种代表人与诉讼代理人又有一定的区别。 1991年4月9日颁布的《中华人民共和国民事诉讼法 》第54条、第55条对集团诉讼作了规定。 |
