| 《汉堡规则》 Hamburg Rules 解释国际货物买卖惯例的通则。旨在全面修订《海牙规则》，以期在承运人和托运人间实现比较合理的权利义务关系。1978年3月6～31日，联合国在汉堡召开有78个国家参加的全权代表会议，通过了《联合国海上货物运输公约》，简称《汉堡规则》。《汉堡规则》的制订和通过，是发展中国家长期共同努力的结果，也是发展中国家在海运方面建立国际经济新秩序的胜利。《汉堡规则》在总结国际航运实践经验的基础上，本着平等互利的原则，废除了《海牙规则》中许多片面袒护承运人利益的、不合理享有的各项免责条款，加大了承运人对货运所应承担的责任，提高了责任赔偿限制的金额，延长了货物提出索赔和仲裁的时效，对承运人与托运人双方的权利和义务作了比较明确合理的规定。这些规定既维护了货方的利益，也考虑了承运人的利益，从而使船货双方对货运所承担的风险趋于平衡。 《汉堡规则》的产生，标志着国际海商法领域发生历史性的变革。对国际贸易、航运、保险、银行业务的发展以及有关法规的调整产生良好的影响。 |
