无权代理是指没有代理权而以他人名义进行的民事行为。
无权代理包括三种情况：
1.没有代理权的代理；
2.超越代理权的代理；
3.代理权终止后而为的代理。
在无权代理的情况下，如果经过本人追认或者本人知道他人以本人名义实施民事行为而不作否认表示的，无权代理人所为代理行为的法律效果归属于被代理人，视为有权代理。此外，无权代理人所为的代理行为，善意相对人有理由相信其有代理权，在此情形下，被代理人应当承担代理的法律后果。
