| 行政救济 administrative remedy 公民或社会组织因其合法权益受到国家行政机关的违法或不当行为侵害时，依法向有关国家机关提出申诉或提起诉讼，要求纠正或给予补救的制度。行政救济制度是民主发展的产物，是保护公民或社会组织合法权益，促进行政机关依法办事的重要制度。它使行政机关的管理活动在发生违法或不当行为以至损害公民或社会组织权益时，能及时得到纠正和补救。 行政救济方式主要是撤销违法的行政决定，变更不当的行政决定，对已造成损害的公民或社会组织给予赔偿或恢复原状。行政救济由行政机关主持解决，它通过行政诉讼或行政复议实现，故有人称它为行政争议。行政救济是行政法制监督的一部分。但行政救济实行不告不理原则，即必须由受损害的相对人提起，国家机关才予受理。 在中华人民共和国，行政救济已形成法律制度，1990年10月1日生效的《行政诉讼法》和1991年1月1日生效的《关于行政复议条例》，建立了行政诉讼和行政复议制度。公民或社会组织合法权益受到国家行政机关违法或不当行为侵害时，可以向造成损害的原行政机关或上级机关申诉并请求复议；也可以向人民法院提起行政诉讼。 |
