买卖双方在合同中规定的价格。又称合同标定价格。价款是经济合同的重要条款。在实行市场经济的国家中，合同中的价款一般由合同双方共同议定。在社会主义中国，合同价格必须遵循国家的价格法律、法规、规章和政策。交易对象是属于国家定价的商品，买卖双方必须执行国家规定的价格；属于国家指导价的商品，买卖双方可以在国家规定的范围内协商议定具体价格；属于市场调节价的商品，买卖双方可以自行协商定价。协议双方必须遵守合同价格。如果一方要求废止合同，提出废止合同的一方要承担经济责任，按合同规定赔偿对方损失。但属于国家定价的，在合同规定的交付期限内调整价格时，按交付时的价格执行；逾期交货的，价格上涨时按原价格执行，价格下降时按新价格执行。
