仲裁协议
仲裁协议指有关当事人根据意思自治和协商一致的原则，自愿将他们之间已经发生或将来可能发生的争议提交仲裁解决的一种表示。 许多国家的立法、仲裁规则及一些国际公约都明确规定，仲裁协议必须是书面的。仲裁协议的类型有两种:①合同中的仲裁条款。指双方当事人在进出口合同中订明，如果发生争议通过协商未能解决时，双方同意将争议提交仲裁。这是双方当事人针对可能发生的争议而预先订立的。②提交仲裁的协议。指在合同中不订立仲裁条款，当事人之间发生争议，经过协商无法解决时，双方达成书面协议同意将争议提交仲裁。这两种仲裁协议的法律效力是相同的。仲裁协议应包括以下主要内容:仲裁事项、仲裁地点的确定、仲裁机构的选择、仲裁规则的运用、裁决效力的确定及仲裁费用的负担。仲裁协议一方面授予了仲裁机构对争议案件的管辖权，另一方面排除了法院对该争议案的管辖权。
