【担保抵押权】德国法律对不动产抵押权所划分的一种类型。担保抵押权的设定要向登记机关登记，但登记机关不作成抵押证书。担保抵押权的特点是抵押权对抵押债权的从属性，债权的存在与否不能以登记为根据，而必须以登记册以外的其他方法独立予以证明，抵押权人必须证明债权的存在才能实行抵押权，如果债权不存在就无从取得抵押权。担保抵押权往往用来作为银行往来账户透支的担保和作为发行无记名债券的担保。担保抵押权可规定担保一定金额范围内的债权，称为最高额抵押权。抵押金额可以在规定范围内随时变动，所以特别适合于担保银行透支。
