我国在1987年加入了《承认及执行外国仲裁裁决的公约》即《纽约公约》,至今已有22年的历史,在此期间我国在仲裁方面有了一定的发展,并与1995年出台了《仲裁法》,本法对《纽约公约》在我国的具体执行提供了一定的法律依据,但是该法中依然有很多规定不明确的地方和相对的法律空白的存在,致使我国在承认和执行外国仲裁裁决的司法实践中出现了较多的问题,并且这些问题的产生已经严重损害了我国国际仲裁声誉。

国内仲裁—国内部对合同纠纷和其他财产权益纠纷的仲裁。在我国是指仲裁机构对平等主体之间的公民、法人和其他经济组织之间的合同纠纷和其他财产权益纠纷，按照仲裁程序进行调解仲裁的一种方法。按照我国经济合同法和仲裁法的规定，经济合同发生纠纷时，当事人不愿通过协商调解解决或者协商调解不成的，可以依据合同中的仲裁条款或者事后达成的书面仲裁协议向仲裁机构申请仲裁，仲裁裁决发生法律效力后，一方当事人不履行的，对方当事人可以向有管辖权的人民法院申请强制执行。
