在保险合同中由被保险人或投保人指定，在被保险人死亡后有权领取保险金的人，一般见于人身保险合同。如果投保人或被保险人未指定受益人，则他的法定继承人即为受益人。受益人在被保险人死亡后领取的保险金，不得作为死者遗产用来清偿死者生前的债务，受益人以外的他人无权分享保险金。在保险合同中，受益人只享受权利，不承担缴付保险费的义务。受益人的受益权以被保险人死亡时受益人尚生存为条件，若受益人先于被保险人死亡，则受益权应回归给被保险人，或由投保人或被保险人另行指定新的受益人，而不能由受益人的继承人继承受益权。
