【契约自由原则]各国民法中都有的一项重要原则，即公民在签订合约时有4种自由:(l)按自己的意志决定是否签订合约的自由，(z)选择缔约对象的自由，(3)决定合约内容的自由，(4)签订合约方式的自由。 但是，缺乏健全意志能力者的契约，违反法令的强制性契约，违反公正善良风俗的契约，乘人之危或构成犯罪行为以及极端侵犯个人自由等的契约，均属无效。 不过，有取消权者不提出取消申请的为有效。未成年人、禁治产或半禁治产者签订的合约以及因强迫、欺骗而签订的合约，如果放置不问，也可以生效。
