kuangehan ziyuan kaieai dengii guanli bonfa《矿产资源开采登记管理办法》(regulationsfo:崛s-teringto而ne而ne耐resouoes)矿产资源法的主要配套行政法规之一，中国地质矿产法律体系极为重要的组成部分。于1卯8年2月12日由国务院发布，并自发布之日起施行。《矿产资源开采登记管理办法》是在总结国务院颁布的《全民所有制矿山企业采矿登记管理暂行办法》施行经验的基础上，依据修改后的矿产资源法制定的。其特点是:①强化了矿产资源属于国家所有的原则。②体现了国家运用经济手段管理矿产资源开发的主导思想。③改变了以往按矿山企业所有制形式分类管理的制度，强调各种经济成分的采矿权人享有平等的权利和义务。④重新界定了矿区范围的概念。⑤完善了采矿权有偿取得制度。⑥强化了采矿权排他性制度。 《矿产资源开采登记管理办法》全文共32条，另加附录，不分章节，采用条款式结构。第一部分(l~3条)为总则，主要规定了该办法的立法目的、立法依据、适用范围、开采登记主管部门及其审批权限。第二部分(4“16条)为程序性和实体性规定，主要规定了采矿权的申请、审批和有偿取得的程序，以及采矿许可证的有效期、采矿权使用费、采矿权价款、采矿权的变更及注销。第三部分(17~25条)为罚则，主要规定了违反本办法有关规定实施的处罚。第四部分(26~34条)为附则，主要规定了采矿许可证的印制、采矿登记费的收取、外商投资开采矿产资源的法律适用、采矿许可证的换领及采矿权使用费的缴纳、采矿许可证的公告、矿区范围的界定，及本办法的生效和以往法规的废止等内容。第五部分为矿种目录，以附录形式规定了国务院地质矿产主管部门负责审批并颁发采矿许可证的权限。 《矿产资源开采登记管理办法》的发布施行，对维护矿产资源国家所有权，保护采矿权人合法权益，完善中国矿业法律制度，推进对外开放，促进中国社会主义矿业市场经济的发育将发挥重要作用。(殷德仁彭绍贤李洪光)
