Analyses on the establishment of marine fishing right regimes in China

The fishing right protected by law was written into the property law, but it is just a general principle,lacking of operable regulations.

According to the industries fishers’ engaging in,fishers’ rights can be classified as rights of survival and development for fishers in fishing industry and aquaculture industry,that is fishing right and aquaculture right.

At the same time, both the flexibility of the transaction of marine fishing right and the impacting factors of the transaction of marine fishing right which are on the fishermen\'s perspective have been analyzed to build the transaction model of marine fishing rights, which is suitable for the characters of marine fishery in China.
