船舶互撞均有过失条款


仍拍互恤均有过失条救在国际海洋货物运输保险中有关船舶碰撞过失责任的处理条款。按照这个条款的规定,如果运输合同中载有本条款,在发生船舶互撞事故后需要被保险人负比例责任时,保险人同意承担这一部分责任。 在《191。年统一船舶碰撞若干法律规定的国际公约》中规定:当船舶发生碰撞互有过失时,相撞两船所载货物的损失,应由过失船舶各按其过失程度比例赔偿。由于一般运输合同中订明,承运人对船长、船员发生疏忽可予免责的条款,承运人对本船承运货物不负责赔偿碰撞所致的损失,故此货物所有人只能向对方船舶追偿到对方过失比例部分的损失。但美国没有参加该公约,按美国法律规定:无辜受害人可以向使他受害的任何一方要求全部赔偿。这样,货物所有人在美国起诉就可以向对方船舶获得全部赔偿,经对方按100%赔付后,可以向承运船摊向承运船过失应负比例的部分。为了能使货物所有人退回根据合同免责条款原来不应该获得的赔偿,承运人特别在运输合同中加上船舶互撞过失条款加以明确,使货物所有人应向其承运人退还他从对方获得的承运方过失比例的赔偿。但货物所有人应向承运人退回的这部分赔款,按照该条款规定,应向保险人索赔,以保证货物承运人获得完整的赔偿。
