The first anti-drug law enforced from June 1st in 2008 abolished detoxification via reeducation-through-labor,and combined the compulsory detoxification with the detoxification via reeducation-through-labor into the forced isolated detoxification.
2008年6月1日我国首部《禁毒法》正式实施,该法取消了劳动教养戒毒,将强制戒毒和劳教戒毒统一为强制隔离戒毒,这对于我国劳动教养制度是一次巨大的冲击,也是此次《禁毒法》中的一项重大立法突破。

| 劳动教养 中国对有轻微违法犯罪行为，不够刑事处分的人实行强制性教育改造的行政处罚。劳动教养由劳动教养管理委员会审批。劳动教养的期限是1～3年，必要时可延长1年。劳动教养期间表现好的，可以减期或提前解除劳动教养。收容劳动教养的范围，目前及今后一段时期，只限于大中城市和家居农村流窜到城市、铁路沿线、交通要道吃商品粮人员中符合收容劳动教养的人。对没有劳动能力的，16周岁以下的未成年人，怀孕或哺乳未满1年的妇女等均不能采用劳动教养。劳动教养管教所在上级主管机关的领导下，具体执行劳动教养人员的收容、管理、劳动生产、教育改造、生活卫生、考核奖惩等强制性劳动教育改造工作。劳动教养“应当采用劳动生产和政治教育相结合的方针”，“教育感化第一、生产劳动第二”。对被劳动教养的人，实行教育、感化、挽救，即立足于挽救，把教育、劳动和感化有机地结合起来，最后达到把游手好闲、不务正业、违犯法纪的有劳动能力的人，教育改造成为自食其力、遵纪守法和有一定文化知识和生产技能的人。 |
