| 父母子女关系 parents and children，relations between 法律上指父母与子女间权利义务的总和。又称亲子关系。父母子女关系通常基于子女出生的事实而发生，也可因收养而发生。前者称为自然血亲的亲子关系，以双方在血缘上的直接联系为根据；后者称为拟制血亲的亲子关系，以收养的法律效力为依据。自然血亲的父母子女关系只能因死亡而终止。父母与子女间的关系，不因父母离婚而消除。拟制血亲的父母子女关系可因收养的撤销和解除而终止。 中国古代的父母子女关系完全从属于宗法家族制度。封建法律中的有关规定以孝道为本。不孝列为十恶之一；祖父母、父母尚在而子孙别籍异财、供养有阙，都须按律科刑。父母对子女握有主婚、教令、惩戒等权，子女的人身和财产权益都得不到保障。外国古代法中有关亲子关系的规定，也都以家族、父母为本位。当代各国的亲属法，除对子女的出生、姓名、父母子女间的扶养等问题有具体规定外，还特别规定父母对未成年子女享有亲权。 中华人民共和国废除了宗祧继承和纳妾制度，嫡子、庶子、嗣子等名目不复存在。法律规定的父母子女关系分为：①父母与亲生子女，包括婚生子女和非婚生子女之间的关系。②养父母与养子女之间的关系。③继父母与继子女之间的关系。父母与非婚生子女之间，养父母与养子女之间，继父母与受其抚养教育的继子女之间，均适用法律对父母子女关系的有关规定，以保护儿童和老人的合法权益。《中华人民共和国婚姻法》规定：①父母对子女有抚养教育的义务。对未成年子女的抚养责任是无条件的，在任何情况下都不能免除；对成年子女的抚养责任，则以子女没有独立生活能力为限。父母不履行抚养义务时，未成年的或不能独立生活的子女，有要求父母付给抚养费的权利。父母还有管教和保护未成年子女的权利和义务。在未成年子女对国家、集体或他人造成损害时，父母有赔偿经济损失的义务。由于父母是未成年子女的法定代理人，父母有管理未成年子女的财产的权利和义务，未成年子女需要从事与其年龄不相称的经济活动时，应当由其父母代理，或取得父母的同意。②子女对父母有赡养扶助的义务。子女不履行赡养义务时，无劳动能力的或生活困难的父母，有要求子女付给赡养费的权利。③父母与子女之间，双方均不得虐待或遗弃。因虐待、遗弃情节恶劣而构成犯罪的，须按中国《刑法》的有关规定予以制裁。④父母和子女有互相继承财产的权利。在父母离婚时，应妥善解决子女的抚养教育等问题。 |
