中日幽粼升瞬娜锻丈作人具康粥黝赌右麟撅粉翻娜{、_1 1988年9月13日，国务院令第13号发布了《国家行政机关工作人员贪污贿赂行政处分暂行规定》，1989年9月8日监察部发布了《暂行规定》实施细则。其中规定:①国家行政机关工作人员及企事业单位中国家行政机关任命的领导人员，利用职务上的便利，贪污公共财物、挪用公款、收受贿赂以及行贿或介绍贿赂的，依照规定，可给予警告、记过、记大过、降级、降职、撤职、开除留用察看、开除的行政处分。对已经人民法院判处刑罚的，以及被依法免予起诉或者免予刑罚的，给予撤职直至开除处分。②对贪污、受贿数额不满50。元的，可给予警告直至降级处分;对贪污、受贿数额在500元以上，不满1 000元的，可给予记大过直至撤职处分;对贪污、受贿数额在1 000元以上的，可给予撤职直至开除处分。多次贪污、受贿未经处理的，按累计数额处分。对违反规定收受各种名义的回扣、手续费等归个人所有的，依照上述规定视同贪污受贿进行处理。③对为谋取不正当利益、行贿或介绍行贿的，根据其数额及其他情节，给予警告直至撤职处分;致使国家利益遭受较大损失的，给予撤职直到开除处分。国家行政机关为谋取不正当利益而行贿，或违反规定，给予个人回扣、手续费，或索取、收受他人财物的，对其直接负责的主管人员和直接责任人员，视情节轻重给予警告直至撤职处分。④对财产或者支出明显超过合法收入、差额较大的，可以责令其说明来源。本人不能说明其来源是合法的，差额部分以非法所得论，由其所在单位或上级主管机关给予行政处分，并没收其财产的差额部分。⑤对利用职务上的便利，挪用公款的，视数额多少及其他情节，给予记过直至撤职处分。挪用公款归个人进行非法活动或者被发现后不退还的，按贪污论处。⑥对在共同贪污中负主要责任的，屡犯不改的，索贿或在涉外活动中受贿的，贪污或挪用救灾、抢险、防汛、优抚、救济、扶贫、防疫款物的，使国家利益受到较大损失的，抗拒调查、打击报复检举人的，同时又有其他违法行为等情形之一的，从重处分。对数额较小、情节轻微的，或主动交代、退还赃款赃物的，或被发现前主动交代的，或揭发检举他人贪污、挪用公款、贿赂行为情况属实的，可以夕、轻、减轻或免予处分〔岔对包庇贪污、贿赂行为的，根据情节轻童给予行政处分。对检举、揭发贪污、贿赂行为的有功人员政监察机关或其主管机关给予表彰或者奖励。由行
