Rechtsscheinhaftung is not only the embodiment of subjective good faith principle , but also abstraction of specific systems such as apparent agency, good faith purchaser, apparent transference of creditor right, which belongs to the academic areas of medium-range theory.
权利外观责任是诚实信用原则之主观诚信具体化的制度体现,又是表见代理、善意取得、债权的表见让与等具体制度的抽象,属中观理论的研究范畴。

我国《海商法》规定了海事赔偿责任限制权利,但实现该权利的相关程序规定不够完善,责任限制基金的司法功能无法得到全面运用,应当正确认识责任限制权利与责任限制基金的性质和相互关系,以此为基础,完善实现责任限制权利的程序。

权利表见责任

For debtor,the foundation of validity is reasonable reliance on the appearance of right to accept,but for creditor,it is Haftung für einen Rechtsschein,which is the core of Rechtsscheintheorie.
债务人对债权准占有人清偿,即债务人对债权文书持有人清偿,其清偿若符合善意且无过失的要求,该清偿行为发生债消灭的效力,效力依据对债务人来说在于对债权准占有人受领权外观的合理信赖,对债权人来说是其引致该受领权外观所应承担的权利表见责任,二者构成债法外观法理的核心。
