To discriminate necessary intentional homicide from unnecessary intentional homicide,and to exclude unnecessary intentional homicide from causing death to another person in the course of robbery,may disclose and punish the homicide.

In recent years our country s cases involving death(refers to eight kinds of cases such as intentional homicide,intentional injure and cause death and explosion;empoison;setting fire,rape;kidnap and cause death) have been increasing,and the rate of exposed intentional homicide is the highest.

The husband s rejection of signing on the operation sheet which resulted in the wife s death has committed a crime of indirect intentional homicide.

Based on the composition of the crime of intentional homicide,the distinction was discussed between this crime and other relevant crimes causing death with the criterion of criminal mind of the offenders.

That will be beneficial to discriminate the crime of intentional homicide and the crime of causing a traffic accident.

Therefore, the author thinks it’s important to perfect the criminal law, especially the theory of the crime of intentional homicide.

According to the judicial practice in China,the "unserious" cases of the intentional homicide crimes refer to those committed under indignation,under long persecution or abuse of the victim,or under the request or promise of the victim.
