In this article ,the author analyzed the conception and, legal nature, the characteristic and function of the lawsuit of debtor firstly ,then unearthed the reasons of our country not to establish the lawsuit of debtor deeply.
我国新修订的民事诉讼法在执行救济制度上进行了较大的完善,区分了程序上的执行救济和实体上的救济,然而始终未设立债务人异议之诉制度,这不能不说是此次修改的一大遗憾。
