认了该宪章中包含的国际法原则。许多国家依照这些原则在本国法律的基础上对第二次世界大战战犯进行了审判。该宪章对于战争法乃至整个国际法的发展具有深远影响。(李鹰程晓霞)国际军手法庭在组伦堡开屣 审判纳粹德国主要战犯诉委员会，以便采取合乎正义的行动。 根据该宪章组成的欧洲国际军事法庭，于1945年11月20日～1946年10月1日举行了著名的纽伦堡审判。1946年12月11日，联合国大会通过第95号(I)决议，确Ouzhou Guoli Junshi Fating Xianzhang《欧洲国际军事法庭宪章》(charte:ofth。角ternational Milita尽Tribunal)亦称《国际军事法庭宪章》或《纽伦堡国际军事法庭宪章》。苏联、美国、英国、法国于1945年8月8日签订的《关于控诉和惩处欧洲轴心国主要战犯的协定》的附件。 宪章共7部分30条，主要内容是:①法庭由苏、美、英、法四国各指派一名法官和一名助理人组成;法官或助理人不能由检察官、被告及其辩护人申请回避，只能由任命他们的政府更换二庭长在4名法官中推选产生并在连续之各个审判中实行轮流充任原则，但如在某一签字国领土内开庭审判时，则由该国在本法庭的法官担任庭长;4名法官构成开庭法定人数;法庭实行多数表决制，如双方票数相等，则庭长有决定权，但有关定罪与科刑之决定必须至少有3名法官投票赞成;必要时得设立其他法庭，其组织、任务及程序应与本法庭一致，并受本宪章支配。②规定l矿列行为属于战争犯罪:危害和平罪，即计划、准备、发动或从事一种侵略战争或一种违反国际条约、协定或保证之战争，或参加为完成上述任何一种战争之共同计划或阴谋;战争罪，即违反战争法规或惯例，包括谋杀及为奴役或为其他目的而虐待或放逐占领地平民、谋杀或虐待战俘或海上人员、谋杀人质、掠夺公私财产、毁灭城镇或乡村或非基于军事上必要之破坏，但不以此为限;违反人道罪，即在战前或战时，对平民施行谋杀、歼灭、奴役、放逐及其他任何非人道行为，或基于政治、种族或宗教的理由，而为执行或有关干本法庭裁判权内之任何犯罪而做出的迫害行为，不论其是否违反犯罪地之国内法规。
